"6. LIMITATION OF RE-USE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes or noncommercial purposes any portion of the services or content contained within Conger Alley. In order to use any content, graphical art, photos or files owned by or published by Conger Alley, direct, written authorization must be obtained from Conger Alley with no exceptions at any time for any reason."
Does this mean that I can never sell or re post in another forum one of my own photos that I have posted on Conger Alley.
Just wondering, not that I would ever get any money for my photos, but I sometimes re post photos on a photog specific forum. Will I get the cuffs slapped on for this cos I have done it in the past :eek: .
Gord can give you his opinion, but I think that refers to others peoples "stuff". Your "stuff" is covered by this section
Any and all content posted for inclusion in publicly accessible areas of Conger Alley are the responsibility of the creator. Conger Alley makes no claims or warranties about such information or its authenticity. Upon posting any content on Conger Alley, you grant Conger Alley the non-exclusive right to publish, modify and use such content solely for the purpose of displaying such content.
and non exclusive is the key word I think

Hope the contents of the section that you quoted provide relevance to the re posting of images on other sites. Glad you pointed that little section out.
I am a little disturbed at some of the content of this other section that you referenced. Its complicated wording seems to indicate to me that ownership of the photographic rights is transferred to the site upon posting images.
Some time ago I was a member of a photographic forum (Site shut down now) that had restrictive terms and conditions applied to contributors images. The terms were a lot more severe than these, but in effect they left the web site owner full copyright ownership of all images posted. Obviously on a dedicated photog site this was a valuable asset, with a gallery of top notch images on file. The photogs kicked off big style and left in droves leaving only snappers and newbies contributing.
If the above was true for C/A it wouldn’t affect most of us snappers. But it would discourage some serious DSLR users with potentially valuable images from posting content.
Wouldn’t mind a plain simple answer in plain English.
Do I maintain freedom of use of any photo I contribute to this site without restriction? Yes or no.
I think PeterM is correct in his stating the non-exlcusive right bit, however, the other term is rather misleading in that it refers to both images etc. owned by and published by.
The owned bit is ok - by publishing photos you do not transfer ownership to the photo. The published bit is a bit more ambiguious. When I post a video on the forum I do not publish it here. I merely link it from youtube. I have never embedded a video (cos I don't know how to - a few moderators have then gone in and done it but that wasn't done by me).
I think for the avoidance of doubt it would be helpful to add a clause to the terms of use that by publishing photos, videos etc. the user does not lose the ownership of them or lose the right to publish them elsewhere.
Simple English is what its all about these days. And Gord, do me a favour, de-americanise that spelling please!

But you cannot publish other people's photos, and when you post your photos here, you're happy for them to be published gratis through Conger Alley.com
